Web design: terms and conditions

Quotations and estimates
A firm quotation can only be given for a website when all the content has been received and all the features of the site discussed. Any estimate given under any other circumstances is for general guidance only.
Quotations remain valid for 30 days from the date they are given.

For any changes to the site requested after the original quotation has been given, the client will be offered an amended quote.

Scope of pricing
In quotations, we endeavour to give clients completely transparency and the absolute best pricing for work on their websites. Experience shows that phone, email and postal contact are usually more than sufficient to achieve clients' precise needs, so we do not automatically include any element for face-to-face meetings. If required, these, and any other matters such as dealing with third parties on a client's behalf, may attract an additional charge.

Site content
Unless otherwise agreed in advance, it is the client's responsibility to provide all textual content for a site in text, doc or rtf format and all artwork and images as gif, png or jpg files. The client must accept liability for ensuring all such material is free from copyright restrictions and must indemnify Terry Gault/insites web design against any costs or damages arising, for example, but not limited to, libel or copyright actions arising from the use of the supplied content.

Sites containing adult and certain other types of content may be restricted in the number of ISP services available. The costs of providing services such as hosting may therefore be higher than generally advertised on this site.

Hosting
Where a client arranges hosting, that client has sole responsibility for ensuring that all necessary actions have been completed by, and any necessary information is available from, that provider in order to upload the site and its features. Where this information or access cannot be provided for any reason, but the site has been built, full payment remains immediately due. Any dealings requested between Terry Gault and the client's ISP will be chargeable in addition to site building costs.

Where TGMS arranges hosting, the client will (except in the case of PAYG sites) be registered as the owner of the webspace and domain name, if applicable. After initial set-up, the client then has the option to either
• assume full responsibility for dealing with the host and domain registry on an ongoing basis, in which case s/he also accepts liability for all dealings with and payments to these parties
OR
• choose TGMS to manage hosting and domain registration, in which case s/he will receive an annual invoice for renewals.

Domain names
The hosting packages we offer include a free .co.uk domain name, subject to availability. Other suffixes, such as .com, .net, .tv and .eu are available at an additional annual cost of between £15 and £50.

Domain name transfers
Transfer of domains with a .co.uk suffix can be accepted into our hosting packages free. Other suffixes may incur an additional charge.

A client who wishes to transfer an existing .co.uk domain name to our hosting package, will be responsible for all dealings with the existing IPSTAG holder to release that name, including any charges they may make. Any dealings requested between Terry Gault and the IPSTAG holder may be chargeable in addition to site building costs.

Payment
Payment for work on sites, obtaining a domain name or hosting must be made in advance. For complete new sites, payment may, by arrangement, be typically 50 per cent before site building commences and 50 per cent upon completion of the work. Sites will usually be viewable in finished form, but only made active on the client's server upon receipt and clearance of the final payment.

Unless by prior written agreement, work for changes, additions etc to existing sites is due in advance of work being carried out.

Payment should be by cheque or bankers draft.

Any payment, or part thereof, once used to acquire hosting and/or domain registration on behalf of and/or in the name of the client becomes non-refundable.

Author/copyright notices

All sites and quotations assume inclusion of typical discrete links to suppliers of copyright standard items used, such as site templates, contact forms etc, and to TGMS as the site builder. Such links can normally be omitted on payment of a small additional fee.

Guarantees
Terry Gault/insites endeavours to check that any site works optimally on a wide range of modern browsers. If, within 12 months, any error should arise from the construction of a site, we will make all efforts to remedy such errors at no cost to the client. This guarantee is invalidated if the site codes have subsequently been worked on or amended by a third party.

Clients should note that browsers can vary in their rendering of websites and particularly older ones may not meet current international standards. While we aim to overcome this as much as possible, older browsers may simply not have the software to handle certain interactive and other features, such as slideshows.

Third parties
Terry Gault/insites has no liability for any failure of any services relating to a website that is subject to an agreement between the client and a third party. However, we will do our best where, for example, the client's host goes out of business, to relocate the site to a new server at minimal cost.
